AGF Management Limited and the group of companies ("AGF," "we," or "us") value the privacy and security of information about AGF’s clients and potential clients. AGF may collect and retain certain information to be in a position to provide various financial products and services to clients, including investment management services and investment products. This privacy policy ("Policy") describes how we may collect, use, retain and disclose certain information collected on websites and in the course of offering our products and services to clients.

By visiting or using the various websites, clicking "I agree" or any other button indicating your acceptance of this Policy, or otherwise providing information to AGF directly or indirectly, you consent to the collection, use, retention and disclosure of information about you as outlined in this Policy. Your use of our websites or your obtaining services from us, and any dispute over privacy of information collected for those purposes, is subject to this Policy as well as to our terms and conditions of use.

Information collected from the use of our websites is controlled by AGF Investments Inc, whose head office is located in Toronto, Ontario, Canada. Information may be transferred to and also collected by an AGF located in your country. Information is also collected from the AGF entity in which you obtain your products and services from and may also be transferred between AGF companies for the purposes of servicing you. Privacy laws in each country differs and the degree of protections vary accordingly. Notwithstanding this Policy, which equally applies across the group of companies, local laws may require or permit certain disclosures of your information without your direct permission of knowledge.

Information collection

AGF may collect, use, retain and disclose Information (information including but not limited to Personal information) in connection with your use of the websites. Personal information refers to any information that alone or together with other information in our possession relates to an identifiable person and may include name, phone number, email address, financial t information, account information and on-line information, such as user name and password.
AGF may, in order to better serve you, combine information we have collected from you in other contexts, such as through our registrar for our exchange traded funds, email exchanges and conversations with you, of from public sources or from your financial advisor or dealer.

What Personal Information do we collect?

We may collect directly from you information at the time you request information from us or when you register to use secure sections of the website. We may collect Personal Information about you when you obtain a service or product from us, including from your financial adviser or dealer. The Personal Information we collect will vary based on our interaction, however it could include:

  • Your name (legal and preferred);
  • Date of birth and gender
  • Postal and email mailing address;
  • Telephone numbers;
  • Account number and associated details (eg tax, financial institution details, etc);
  • User name, password, and answers to security questions; and
  • Other information you provide to us
  • For identification or authentication purposes and
  • In connection with your enquiries and/or with your account.

We also may collect Personal Information for your account from third parties authorized to disclose your Personal Information, such as from your financial advisor, your financial institution or other 3rd parties connected to you and your account with AGF.

We may collect information from you regarding other individuals associated with your account. For example, beneficiaries and other parties authorized to instruct or discuss your account (e.g. your financial advisor, accountant and other professional. In disclosing information about these 3rd parties you are confirming you have the consent of those parties to do so and for AGF to collect, use, retain and disclose that information as may be required to continue to service your account.

Information we collect systemically

Our Sites use a variety of technologies, such as cookies, web beacons, and similar mechanisms to collect information about how our websites are being used. Technical and navigational information about you may be collected and used to direct you to relevant content on the websites, such as your internet protocol (“IP”) address, your general geographic location, the date and time of your visit; web pages you view and links you ‘click’. These technologies helps us to provide you with a useful experience when you browse our websites.

In some cases, you have the ability to choose whether to accept the provision of information via these technologies. For example, you can set your browser to refuse all cookies or to indicate when a cookie is being setup, allowing you to select whether or not to accept it. In the case of cookies, you can also delete them when you delete your browser history. Notwithstanding your ability in some cases to choose to accept or not accept the sending of information, it is important to understand that if you choose to block or delete cookies for example, certain features of the website may not operate as intended reducing or impeding your experience on the website.

Use, retention and disclosure

We use the Information that we collect for the purposes for which it was provided to us, for business purposes and as required by law. For example, we use, retain and may disclose the Information in the following ways, as applicable:

  • To comply with our legal obligations and protect our legal rights (such as to comply with record-keeping, reporting, and tax obligations under applicable law;
  • To count and recognize visitors to our websites as well as identify which sites are applicable to them (e.g. geographic location, etc);
  • To improve, enhance and maintain our website performance, navigation and functionality; and
  • For research and analytical purposes to better serve our current and future clients.

We may disclose Information to third parties and within the group of companies, as permitted by law, for the following purposes:

  • to our affiliates to provide you with the products and services you request as well as to provide you with relevant reporting and generally to communicate with you and the parties you authorize us to communicate with in respect of your account with us;
  • to our 3rd party service providers, who use it to perform tasks on AGF's behalf in the provision of products and services to you (for example to prepare and mail account statements, transfer agent to our products, etc.)
  • to AGF’s professional advisors (e.g. legal, taxation, etc), auditors and operational consultant to assist AGF in meeting its obligations;
  • to your identified 3rd parties you authorize concerning your account with us (for example, your accountants, financial adviser, financial institution, legal representative, beneficiaries, etc.);
  • to regulatory authorities pursuant to legal obligations associated with the provision of products and services to you (e.g. Canada Revenue Agency, Financial Transactions and Reports Analysis Centre of Canada, etc);
  • to other websites and services to the extent you use features on our website that permit you to share directly, content through social media sites such as LinkedIn, Facebook, etc; and
  • to our technology service providers that may maintain systems and servers for our systems and websites.

We retain Personal Information for as long as necessary to provide you with the services you requested and as required by law, regulation, or internal policy. Various laws require us to retain certain information for lengthy periods of time and to ensure we have reasonable protections in place to safeguard the information. We use commercially reasonable physical, electronic, and procedural safeguards to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction in accordance with applicable law. Despite our best efforts, no security measures can guarantee 100% security all of the time. We recommend that you take steps to protect against unauthorized access to your password, phone, and computer and also recommend that you take measures to encrypt or password protect any files or records you share or transmit electronically.

Cross-border sharing of information

AGF may use service providers in its operations that may house their systems, servers and the data contained therein outside of Canada.  AGF contractually endures appropriate security and privacy protocols are in place with these suppliers in order to protect information from unauthorized use, alteration, destruction and loss.  Service providers however, may themselves be subject to local regulatory requirements that require them to disclose information to designated authorities such as law enforcement or local governments without AGF’s or your permission.

Accuracy and completeness of information

AGF relies on the accuracy of the information provided to us, despite taking reasonable efforts to ensure that the Information collected by us or on our behalf is accurate, complete and up to date.  If you have any concerns regarding the accuracy of information about you held by us, contact us.

Your right to access and correct your information

You generally have to right to request access, review, correct, delete, or inquire about the information we retain about you. You also may have a right to oppose or limit the collection and processing of your information, or to revoke your consent, although in doing so, we may be unable to continue to provide services to you and your account may be closed as a result.

If you would like to access, review, correct, delete, inquire about your information or place certain limitations on its use, collection and retention, please contact us. When we respond, we may need to take certain additional steps, such as to verify your identity, before we can grant your request. In the event we are unable to grant your request, as permitted by law, we will notify you of the basis for such denial.
